Just Candy prides itself in providing the highest possible levels of customer service. Please take time to read our terms and conditions before ordering any of our gift vouchers. Once you have purchased or redeemed a voucher or a gift from justcandygifts.com you become legally bound by these terms and conditions.

Just Candy will supply gift vouchers to you and will take all payments in relation to the purchase and any additional charges. If you require any further details with regards to redeeming your voucher or booking your experience, please contact the customer service team at: info@justcandygifts.com

When the recipient of the gift voucher books an experience, they will enter into a separate contract with the supplier and become subject to their terms and conditions for the duration of their experience.

Acceptance of terms and conditions
By purchasing, booking, participating or redeeming a Just Candy Gift experience/voucher or by accessing, browsing and using any part of the www.justcandygifts.com you agree to the following terms and conditions as well as all other applicable laws.

Prices
The prices displayed on our website are correct at the time of publication. We reserve the right to change prices without notice and prior to confirmation and receipt of full payment by Just Candy, providing we inform you at the time of ordering and purchasing of your experience.

Just Candy is not obliged to adjust in any way its prices for any reason with regards to any dispute that another party may have.

Descriptions
The descriptions of experiences and venues on the website and in the voucher pack are indications only of that event. There may be slight variations in schedules, venues and timings.

Images
Pictures used in all promotional literature to illustrate experiences are used as an indication and for information purposes only.

Cancellations
Once you have booked and confirmed your experience with your service provider, cancellation of your experience is not possible. If you decide to cancel, this will result in the loss of the total value of your experience.

Rescheduling of experiences will occur from time to time due to weather conditions, mechanical failure, staffing problems or illnesses, which are out of our control. Just Candy or the supplier will notify you as soon as possible and an alternative date and time will be offered to you. We apologise but in these circumstances Just Candy are unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled experience or offer any refund of the purchase price.

If the experience is cancelled indefinitely then they can exchange the voucher for another experience in accordance with the terms below.

If the participant decides not to take part in a booked experience refunds are not entitled.

Exchanges and returns
Exchange of gift vouchers is only possible within 14 days of the purchase date for an additional administration charge of 25 €. The original voucher must be returned to the Just Candy offices before exchange can be made. Only one exchange is allowed.

After the 14 day period, exchange for a different experience is not possible. Exchanged vouchers cannot be refunded.

Should the recipient wish to change the experience for a more expensive one, the difference must be paid in full at the time of re-booking. For an experience less than the voucher price, the remainder of the monies will be held in credit in a customer account for the recipient until they are ready to purchase another experience. This money will be held up until the expiry date of the voucher. If no experience has been booked within this time, the account will become null and void.

If the supplier, or Just Candy cancels your experience indefinitely, the recipient is entitled to exchange for another Just Candy experience of equal value. You will not be entitled to a refund.

Refunds
Refunds of gift vouchers can only be made within 28 days to the original purchaser. The purchaser must make the request for a refund in writing and the original voucher returned to the Just Candy offices within the 28 days period. All monies will be refunded to the credit card used for the transaction, less a 25 € administration charge.

No refunds are possible for already booked experiences. Once you have booked and confirmed the dates of your experience, you may incur a cancellation charge if you have to re-book. Please check with your service provider upon booking. Each service provider holds their own terms and conditions, cancellation and refund policies which customer/recipient/user accepts at the time of booking the experience. These conditions are available to all customers/recipients and users in writing upon request.

Expiry dates
Your voucher lasts for a period of 10 months from the date of purchase. You must schedule your experience within this time frame. The expiry date can be found in your information pack. After this date your voucher becomes invalid.

Just Candy shall take no responsibility for lost, stolen or damaged vouchers. In this instance vouchers cannot be replaced.

Payment
We accept all major credit cards. Vouchers are dispatched once full payment has been received. We reserve the right to cancel any order where full payment has not been received within the credit terms and conditions or where a payment has defaulted. Vouchers will become void in these circumstances and the purchaser will be subject to any costs incurred.

We do not accept payments by instalments.

Accuracy
We do our best to ensure that everything you read and see is accurate when going to publication however; the website may still contain some technical inaccuracies and typographical errors.

Weather
Certain experiences are weather dependent and may have to be withdrawn due to poor conditions. If in doubt on the day of your experience, please contact your service provider before leaving. Your service provider or we will endeavour to re-schedule your experience as soon as possible in this instance, without penalty. Just Candy is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled experience.

Duration of Experiences
The duration stated on the information packs for each experience is an approximate time and may vary from venue to venue. Itineraries are to be used as a guideline only, as the running order on the day of your experience may change. If more participants take part, the recipient will have to accept the roster system provided by the supplier.

Restrictions
All experiences have certain restrictions and requirements with regards to weight, height, age, health and legal requirements. If you are in any doubt that you cannot fulfil these requirements on an experience that you wish to purchase, please contact your service provider directly and they will advise you. You may receive full details of terms and conditions from your service provider upon request.

If you have booked an experience knowing that these restrictions can not be met by yourselves or other participants, you may be liable for charges if your service provider has to cancel because you cannot meet these minimum requirements. Certain experiences require you to provide a health certificate or/and sign a medical declaration or disclaimer before taking part in the experience. If any of the required restrictions have been breached, your experience will be cancelled and all costs will be withheld.

Safety
Many of our experiences may involve varying degrees of risk. You may be required to sign a disclaimer before participating in an experience. We advise you to take out additional insurance cover for personal accidents, loss of limbs and even death before taking part in certain experiences.

Your safety is paramount at all times during your experience. It is important that you listen to your service providers with regards to safety procedures and adhere to them. Failure to do so will result in the termination of your experience.

Some service providers recommend or require certain items of clothing and/or footwear to be worn and brought to the experience. Restrictions may also apply to clothing worn for an experience. Please make sure you comply with these requirements before setting off for the experience. Just candy will not be held liable for the non-provision of an experience due to a failure by the participant to bring or wear the required clothing and/or footwear. In this instance, the experience cannot be rescheduled and the value of the original voucher will be forfeited.

Copyright terms and conditions & property rights
All illustrations, images and text used on the Just Candy Gifts website and on all promotional materials are protected by copyright. You may only download material and content for non-commercial use without written consent from Just Candy.

All the contents, trademarks and data on the website, including but not limited to software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to Just Candy and as such are protected from infringement by local International legislation and treaties. Any copying or unauthorised use of the website shall constitute as infringement of the intellectual property rights of Just Candy.

Complaints
If you have any problems on the day of your experience, please bring it to the attention of your service provider immediately so that they have the opportunity to put matters right. Please send your written concerns to us at admin@justcandygifts.com and all complaints will be fully investigated by Just Candy Gifts; our service to you is our first priority.

Service providers and venues
Just Candy has carefully sourced all service providers and venues. Due to reasons beyond our control, service providers may need to withdraw venues featured on the website or in our literature. If this occurs you will be offered an alternative venue wherever possible or an alternative experience gift voucher of the same face value. Just Candy shall not be held responsible for any losses, damages, expenses or liabilities you incur in connection with an experience. Each venue holds its own terms and conditions and the customer or recipient is deemed to be aware of these conditions on acceptance of participation of an experience.

Just Candy is independently owned and operated. Service providers are individually responsible for the health and safety standards and operating practices. Just candy therefore, makes no guarantees of the consistency or efficiency of individual service providers.

Delivery
Delivery of vouchers is to be made within five working days by an accredited courier service in Spain and can be delivered worldwide or to any European destination. Full and correct delivery address details must be provided to Just Candy upon purchase of your voucher. Delivery can be made directly to the recipient or to another address at your request. If the courier company cannot deliver the voucher pack to you because of inaccurate contact details supplied, any subsequent deliveries will be made at your cost. Just Candy shall not be liable for late deliveries for any reasons beyond their control. All prices, times of delivery and receipt concerning this can be found on the Voucher Delivery page.

Holiday orders
If you want to receive gift vouchers prior to the 25th December, the last order date for standard courier delivery is the 14th December by 12:00. E-vouchers are available until the 21st December.

Voucher Extensions
All Just Candy vouchers have an expiration date of 10 months from the date of purchase. If no extension has been requested, the voucher becomes invalid. To request an extension of your voucher, please return your original voucher back to us at Just Candy Gifts and a new voucher for a further 3 months period will be issued. All extensions will be subject to an administrative fee of 25 €. Application for extensions can only apply once from an original purchase order.

Voucher/presentation pack
Each Just Candy gift purchased will receive a voucher with full information regarding the experience.

Your voucher is an important document and must be kept safe at all times. This is your proof of payment. Photocopies of vouchers will not be accepted upon redeeming your experience with a supplier. Only originals will be accepted. Gift vouchers hold individual security tags and security code numbers.

The Just Candy gift pack includes: printed gift voucher, product codes and a personal booking reference number. The details in your pack must be used in all bookings and transactions made with Just Candy.

Just Candy holds no responsibility for lost, stolen or damaged vouchers. If your voucher is found to have been tampered with or the security codes and tags removed, you will not be able to take part in your experience.

Insurances
By booking and/or redeeming experiences with Just Candy Gifts, purchasers, recipients and users indemnify Just Candy Gifts and any of their employees and agent/s against any claims, damages or loss whatsoever.
Just Candy does not hold any insurance for gift experiences.

All service providers are requested to hold an insurance policy for their business for third party liability cover. This is the sole responsibility of the service provider to ensure that these insurances are in place before the participation in experiences or events. Just Candy can advise customers, recipients and users on additional personal accident and cancellation insurance if requested in writing. Liability
Great care has been taken in choosing our service provider’s and venues. Just Candy does not guarantee the safety standard or satisfactory performance of any service provider, nor are we liable for any loss or damage suffered by a client whilst participating in the experience for which the service provider will be solely responsible.

Just candy accepts no responsibility and shall not be liable for any claims for loss, injury, damage or any special exemplary punitive indirect incidental consequential damages of any kind whether based in contract, strict liability or otherwise which arise out of any connection with the use and redemption of a voucher or the performance or non-performance by any service providers, even if all parties have been advised of the possibility of damages. Just Candy shall under no circumstances be liable for any delay or failure of performance resulting directly or indirectly from an act of nature or causes beyond its reasonable control.

Other terms and conditions
Please be aware that some experiences may incur additional costs to be paid directly to the service provider with regards to travel to and from a venue requested by you. This cost must be paid at the beginning of your experience. This will be stated clearly in your information pack and your service provider upon booking will confirm confirmation of full payment due. Just Candy reserves the right to change the terms and conditions without prior notice to recipients of vouchers/customers.

Jurisdiction
Justcandygifts.com is a website owned by the Just Candy Group in Marbella, Spain and as such any disputes arisng from these terms and conditions shall be dealt with in a Spanish Court of Law.
